Portugal’s Nationality Law Sparks Controversy: Over 500 Golden Visa Holders Plan Collective Lawsuit
According to Portuguese media outlet Expresso, following the official signing and implementation of the new Nationality Law, more than 500 foreign nationals holding Golden Visas (ARI residence permits) are preparing to file a collective lawsuit against the Portuguese government. The dispute centres on the significant extension of the residency requirement for citizenship, a change that has already had a direct impact on many investors’ long-term plans.
Higher Citizenship Threshold Disrupts Investor Expectations
Under the new rules, the minimum residency period required for foreigners to apply for Portuguese citizenship has been extended from five to ten years. For citizens of the Community of Portuguese Language Countries (CPLP) and EU member states, the requirement has increased from five to seven years.
This adjustment is widely seen as one of the most impactful changes to Portugal’s immigration policy in recent years. For many investors who had structured their plans around the Golden Visa pathway, the previously clear timeline has been significantly extended, forcing some to reassess their migration strategies and asset allocation plans.
Investors Organise as Legal Action Gains Momentum
Reports indicate that the group of affected investors is primarily composed of US citizens, alongside applicants from various other countries. These individuals have formed communication channels via platforms such as WhatsApp and are planning to formally establish an association in the near future to coordinate their legal efforts.
At the same time, more than 500 individuals have already engaged multiple law firms to represent their interests. Legal teams are currently advising clients to delay formal legal action until the government releases detailed implementation regulations, allowing for a more comprehensive legal strategy. The group has stated that it will pursue all available legal avenues within Portugal and, if necessary, escalate the case to European judicial institutions.
Policy Changes Reshape Market Sentiment
With the new law coming into force, some investors have begun cancelling or suspending their residency applications. Market observers note that the extension of the citizenship timeline may weaken the appeal of the Golden Visa programme, particularly for applicants whose primary objective is long-term residency and citizenship planning.
However, others argue that Portugal’s strong fundamentals — including quality of life, a stable legal framework, and the value of EU citizenship — continue to support its long-term attractiveness. In this view, short-term policy adjustments may not fundamentally alter Portugal’s position in the global investment migration market.
